Mr. Lucas has an acute base of knowledge in family and juvenile law regarding legal issues in this region.
Mr. Lucas earned a bachelor or arts degree from Maryville College and a doctorate of juris prudence from Nashville School of Law.
Within two years of being licensed to practice law, Mr. Lucas litigated in front of the Supreme Court of Tennessee for a Knoxville client regarding a family law matter. If an error is made by the trial courts, Mr. Lucas has successful experience litigating in the Tennessee Court of Appeals.
Mr. Lucas will take the matter to the next level.
Mr. Lucas started a case with a motion to dismiss for lack of subject matter jurisdiction, where it was denied at trial in the Fourth Circuit Court for Knox County. The client wanted to appeal.
Mr. Lucas appealed to the Tennessee Court of Appeals for the Eastern Section. In a unanimous 3-0 decision for Mr. Lucas, Justice Charles D. Susano delivered the opinion, Chief Justice D. Michael Swiney and Justice Thomas R. Frierson, II concurred in The Opinion.
Despite the unanimous decision in the Tennessee Court of Appeals, the opposing counsel appealed to The Supreme Court of Tennessee. The precedent set in The Opinion by Justice Susano opened the door for many other appeals in circuit and chancery courts across the State of Tennessee. As a result, the Tennessee Legislature went to work to amend Tennessee Law targeted at The Opinion. The legislation was to apply to any case pending or on appeal.
On April 24th of 2019, the amendment was signed by the Governor of Tennessee and enacted. Litigation took place in The Supreme Court of Tennessee on April 7, 2019, only two weeks after the amended statute was enacted. The Supreme Court of Tennessee, following the newly enacted amendment to the statute, reversed The Court of Appeals for Tennessee.
This case highlights the endurance and perseverance of Mr. Lucas when a client believes the lower courts made an error. In addition, it highlights the complex and changing parts involved in litigation. You may have the facts and law on your side in the beginning, but laws and facts can change as a matter is pending.
